Phogator collects facial photographs (“Selfies”) submitted by users during event registration. These images are used for identity verification and event participation management.

Facial images may constitute biometric data under certain data protection laws.

2. Purpose of Processing

Facial images are processed for the following purposes:

Event registration and access management
Identity verification during event check-in
Prevention of duplicate registrations
Administrative and security purposes

Phogator does not use facial images for advertising, profiling, or commercial resale.

3. Automated Processing

Facial images may be processed using automated systems for facial comparison and verification.

At this time, Phogator does not implement advanced liveness detection, anti-spoofing, or deepfake detection technologies. While reasonable security safeguards are in place, the system may not detect impersonation attempts involving photographs, digital reproductions, masks, or manipulated m

4. User Responsibility

Users are solely responsible for ensuring that:

The uploaded image is their own
The image is authentic and not manipulated

Submission of another person’s image without authorization is strictly prohibited.

Facial images are retained only for as long as necessary for:

The relevant event duration
Post-event reconciliation and security purposes
Compliance with legal obligations

After this period, images are securely deleted or anonymized.

6. Security Measures

Phogator implements reasonable administrative, technical, and organizational safeguards to protect stored images. However, no digital platform can guarantee absolute security.

7. Consent

By uploading a facial image, users:

Explicitly consent to the collection and processing of their image
Acknowledge the system’s current technological limitations
Accept the risks inherent in digital identity verification systems

Terms & Conditions – Identity & Limitation Clauses

By accessing Phogator, you agree to the following terms.

1. User Identity and Image Authenticity

Users agree to upload only their own current and authentic facial image for registration purposes. The following actions are strictly prohibited:

Uploading another individual’s image
Using AI-generated, altered, or manipulated media
Attempting impersonation
Circumventing identity verification systems

Violation may result in account suspension, event access denial, or legal action.

2. System Limitations

Users acknowledge that:

Phogator utilizes automated facial comparison technologies.
The platform does not currently include advanced liveness detection or anti-spoofing controls.
The system may not detect fraudulent or spoofed submissions in all cases.

Phogator makes no warranty that identity verification mechanisms are foolproof or immune to circumvention.

3. Limitation of Liability

To the maximum extent permitted by law, Phogator shall not be liable for:

Identity misrepresentation by users
Unauthorized impersonation
Damages arising from fraudulent submissions
Technological limitations of facial verification systems

Users assume responsibility for truthful and lawful participation.

4. Right to Suspend or Terminate

Phogator reserves the right to:

Reject registrations
Suspend accounts
Remove event access
Investigate suspicious activity
Report unlawful behavior to authorities

Without prior notice where misuse is suspected.

5. Indemnification

Users agree to indemnify and hold harmless Phogator from any claims, damages, or losses arising from:

Misuse of the platform
Submission of unauthorized images
Violation of these Terms

6. Governing Law

These terms shall be governed by and construed in accordance with the laws of Nepal.
